H.Amdt.370 to H.R.4365 FY24 DoD Approps Amendment — Prohibit Cluster Munition Transfer

Prohibits funds from being used to transfer cluster munitions under the FY24 Department of Defense Appropriations Act. Transfer-only scope. Cluster munitions are prohibited by the Convention on Cluster Munitions (CCM, adopted May 30, 2008; entered into force August 1, 2010), which bans use, development, production, acquisition, stockpiling, retention, and transfer of cluster munitions. As of 2024, 112 states are parties (124 total signatories); the United States has not signed or ratified the CCM. The CCM is grounded in the international humanitarian law principles of distinction and proportionality (Geneva Conventions Additional Protocol I, Articles 48 and 51) and responds to documented civilian harm from unexploded submunitions.
