H.Amdt.243 to H.R.2670 FY24 NDAA Amendment — Halt Cluster Munition Transfer to Ukraine

Prohibits sale or transfer of cluster munitions specifically to Ukraine under the FY24 National Defense Authorization Act. Cluster munitions are prohibited by the Convention on Cluster Munitions (CCM, adopted May 30, 2008; entered into force August 1, 2010), which bans use, development, production, acquisition, stockpiling, retention, and transfer of cluster munitions. As of 2024, 112 states are parties (124 total signatories); the United States has not signed or ratified the CCM. The CCM is grounded in the international humanitarian law principles of distinction and proportionality (Geneva Conventions Additional Protocol I, Articles 48 and 51) and responds to documented civilian harm from unexploded submunitions. Article 21(2) of the CCM additionally requires states parties to discourage non-state-party use of cluster munitions. Ukraine is not a CCM party.
